EPA Settles with Medline Industries for Sale or Distribution of Unregistered Pesticides

 

CHICAGO  - Today, the U.S. Environmental Protection Agency (EPA) announced an agreement with Medline Industries of Northfield, Ill., that resolves allegations that the company violated the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) on 1,291 occasions by selling or distributing an unregistered pesticide. Medline has agreed to pay a $4,930,000 administrative penalty for the alleged violations.

 

“The sale and use of unregistered pesticides pose serious threats to public health in our communities,” said Regional Administrator Cathy Stepp. “Companies must ensure that the pesticides they distribute or sell are registered with the EPA with approved label instructions so that they can be used safely and effectively.”

 

EPA conducted an inspection at Medline’s Northfield headquarters and documented the distribution or sale of Micro-Kill 70 Isopropyl Wipes to hospitals, clinics, hospice centers, and other healthcare facilities nationwide.

 

Because of claims that Medline made in the marketing and labeling of Micro-Kill 70 Isopropyl Wipes, the product should have been registered as a pesticide with the EPA. The use of unregistered pesticides in healthcare facilities is potentially dangerous because such products have not been determined to be effective against the sorts of pathogens found in these settings, nor do they provide directions for use that have been approved by the EPA.

 

In February 2018, EPA issued a “stop sale, use, or removal order” to Medline. The same month, in accordance with the order, the company stopped distributing or selling Micro-Kill 70 Isopropyl Wipes. Since that time, Medline has changed the product’s name to Touch Screen Cleaning Wipes and the label clearly states that the product should only be used to clean dirt, grime and smudges from touch screens and energized equipment. Medline notified its customers that Micro-Kill 70 Isopropyl Wipes should not be used for disinfection purposes. Medline also offered to provide new Touch Screen Cleaning Wipes labels to customers with remaining stocks of Micro-Kill 70 Isopropyl Wipes.

 

The Federal Insecticide, Fungicide and Rodenticide Act helps safeguard the public by ensuring that antimicrobial pesticides are determined to be effective and are used, stored and disposed of safely, consistent with approved label directions. Pesticide registration and labeling requirements protect public health and the environment by minimizing risks associated with the production, handling and application of pesticides.

EPA Announces Public Hearing on Affordable Clean Energy Proposal

Listening Session to Be Held in Chicago, Ill.

 

WASHINGTON - On October 1, 2018, the U.S. Environmental Protection Agency (EPA) will hold a public hearing on the proposed Affordable Clean Energy proposal in Chicago, Ill. The proposal would replace the prior administration’s Power Plan (CPP), which many have criticized as overly prescriptive and burdensome, with an approach that empowers states, promotes energy independence, and facilitates economic growth and job creation. Specifically, the ACE Rule establishes emission guidelines for states to use when developing plans to limit greenhouse gas emissions at their power plants.

Oral comments and supporting information presented at the public hearing will be considered with the same weight as written statements and supporting information submitted during the public comment period. Background

The proposal will work to reduce GHG emissions through four main actions:

 

  1. ACE defines the “best system of emission reduction” (BSER) for existing power plants as on-site, heat-rate efficiency improvements;
  2. ACE provides states with a list of “candidate technologies” that can be used to establish standards of performance and be incorporated into their state plans;
  3. ACE updates the New Source Review (NSR) permitting program to further encourage efficiency improvements at existing power plants; and
  4. ACE aligns regulations under CAA section 111(d) to give states adequate time and flexibility to develop their state plans.

 

Key findings from the regulatory impact analysis include the following:

 

  • EPA projects that replacing the CPP with the proposal could provide $400 million in annual net benefits.
  • The ACE Rule would reduce the compliance burden by up to $400 million per year when compared to CPP.
  • All four scenarios find that the proposal will reduce CO2 emissions from their current level.
  • EPA estimates that the ACE Rule could reduce 2030 CO2 emissions by up to 1.5% from projected levels without the CPP –  the equivalent of taking 5.3 million cars off the road. Further, these illustrative scenarios suggest that when states have fully implemented the proposal, U.S. power sector CO2 emissions could be 33% to 34% below 2005 levels

EPA Extends Public Comment Period on Draft Clean Air Act Permit for Veolia’s Hazardous Waste Incinerator in Sauget, Illinois

CHICAGO - The U.S. Environmental Protection Agency (EPA) has extended the public comment for the draft revised Clean Air Act Title V permit for Veolia’s hazardous waste incinerator in Sauget, Ill. The draft operating permit revises the permit that EPA issued in January 2017.

 

The public can comment on the draft permit until November 5, 2018, extended 60 days from September 5. EPA extended the comment period in response to requests from the public. EPA held a public hearing to accept comments regarding the draft operating permit on August 21 in East St. Louis.

 

Veolia, which is located at 7 Mobile Avenue in Sauget, owns and operates a hazardous waste incinerator that accepts offsite waste, and treats, stores, and disposes the waste through incineration. EPA issued the original permit for Veolia in January 2017. On July 13, 2018, EPA proposed to revise the January 2017 permit consistent with an agreement it reached with Veolia in March 2018. The draft permit requires Veolia to install and operate activated carbon injection systems (ACI systems) on two incinerators that currently do not have controls for vapor phase mercury (i.e., Units #2 and #3) and makes other revisions to the permit consistent with that agreement.
